On August 14, 2007, The Finish Line, Inc. (the “Company”) and Genesco Inc. (“Genesco”) issued a joint press release announcing that the Federal Trade Commission has granted early termination of the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act of 1976, as amended, with respect to the previously announced agreement and plan of merger by and among the Company, Genesco and Headwind, Inc., a wholly-owned subsidiary of the Company. A copy of the press release is attached as Exhibit 99.1 hereto.
