Item 1.01 Entry into a Material Definitive Agreement
On September 24, 2009, Berry Petroleum Company (Company) executed a crude oil purchase contract with ExxonMobil Oil Corporation for the sale of all of the Company's crude oil production from its Midway Sunset Field. The volume approximates 12,600 barrels per day. The Agreement
is effective on October 1, 2009 and continues until September 30, 2010. A copy of the crude oil purchase contract, redacted to delete commercially sensitive information, will be filed as an exhibit to the Company's quarterly report on Form 10-Q for the fiscal quarter ending September 30, 2009.
