In the complaint, the defendants are alleged to have violated certain provisions of the Securities Exchange Act of 1934. Specifically, the complaint alleges, among other things, that defendants’ misrepresented and/or failed to disclose during the Class Period that its heart rate monitoring technology was inaccurate and did not consistently deliver accurate heart rate readings during exercise posing serious health risks to users of Fitbit’s products. Following a consumer class action filed on January 5, 2016 alleging that the heart rate monitoring systems on Fitbit’s Charge HR and Surge devices were dangerously inaccurate and posed serious health risks, the Company’s stock dropped significantly.
