Pandemic 'excuse' keeps Dad from daughter, until he wins in court

Calumet City, Illinois May 28, 2021 (Issuewire.com) - A child was withheld from her dad, with the coronavirus pandemic being used as an excuse - a frequent occurrence over the last 14 months - until he went to court and obtained the parenting time schedule he wanted and deserved.

Dad was never married to the mother of his 8-year-old daughter, and he didn't have the necessary court-ordered parenting time to protect his relationship with his daughter - meaning he was able to see his little girl only as the mother allowed.

To the extent the mother consented, Dad was an involved, loving, caring and supportive parent since the girl's birth, and remains able to provide a warm and stable environment.

But once the pandemic hit and the lockdown were declared last year, the mother denied Dad any time with his daughter, using the pandemic as an excuse, according to court documents. "The mother had a list of demands and limitations for Dad regarding parenting," Leving says. "Fortunately, Dad retained me, I said no way! My legal team went to court, argued the case and convinced the judge. We won. We obtained a generous parenting time schedule - everything Dad wanted - with no restrictions, freeing Dad from the mother's unreasonable demands."

This court victory, modified for broadcast, puts Dad where he belongs - spending time with his daughter. "This was not an easy case," Leving says. "It required diligent preparation, and we had to be ready to present vigorous arguments, but the result was rewarding for this dedicated dad and his daughter - and for me."

Leving also will apprise listeners of his speech at the annual Families and Fathers National Conference in Los Angeles, in which he addressed the civil rights of fathers. "I see discrimination against many of my clients - based on gender, race, income, disability, or based on the fact that they have low-paying blue-collar jobs, unable to meet basic living expenses," Leving says. "Justice should not be a luxury only the rich can afford. I think exposing discrimination helps create accountability, awareness and justice."

Leving will give examples of cases he has won on behalf of fathers being treated unfairly, and a case he's working on now with co-counsel on behalf of an African-American man who was shot by police.

"These are examples of what I consider to be blatant disrespect and injustice," Leving says. "I've litigated many cases where fathers were getting abused by the system, until I insisted that they be treated properly. It's been a long, hard road, and we're not there yet in terms of justice for all fathers, but I think there's light at the end of the tunnel. That's what I told them in Los Angeles."
