Item 8.01.

Other Events.

On March 21, 2013, Gevo, Inc. (the “Company”) issued a press release announcing that a judgment of non-infringement will be entered in favor of the Company in Case No. 1:11-cv-00054-SLR, the lawsuit filed against the Company by Butamax™ Advanced Biofuels, LLC (“Butamax”) in the U.S. District Court of Delaware, alleging that the Company is infringing one or more claims made in Butamax’s Patent Nos. 7,851,188 and 7,993,889. As a result of this judgment of non-infringement, the trial scheduled to commence on April 1, 2013 will no longer take place. A copy of the press release is attached as Exhibit 99.1 to this Current Report on Form 8-K and incorporated herein by reference.
