Remarks:
Mr. Kolarik is an employee of Harbinger Capital Partners LLC ("Harbinger LLC"). Harbinger LLC is affiliated with Harbinger Capital Partners Master Fund I, Ltd., Global Opportunities Breakaway Ltd., Harbinger Capital Partners Special Situations Fund, L.P. and Harbinger Group Inc. and certain of such entities' other affiliates. Such entities collectively own a majority of the Issuer's outstanding shares of common stock. As a result, Mr. Kolarik and the other persons described herein may be deemed to be members of a "group" for purposes of the Securities Exchange Act of 1934, as amended. Each such person disclaims beneficial ownership of any securities deemed to be owned by the group that are not directly owned by such person. This report shall not be deemed an admission that Mr. Kolarik or the other persons described herein are members of a group or that they beneficially own any securities not directly owned by them.
